These Conditions will be accepted by the parties without firmly, and may be modified at any time and without prior notice, so it will be the responsibility of the User to read them each time they make a purchase or contract. The active conditions at the time of conclusion of the contract will be those that are applicable.

APPLICABLE REGULATIONS

This electronic contract is ruled by the Spanish regulations and specifically by the legal regime imposed by Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (LSSICE) and by Law 03 / 2014, of March 27, General for the Defense of Consumers and Users (LGDCU).

SOPPING PROCESS

Shopping at Mumy Room is easy and simple; only follow the following steps:

1º.- Select the products you wish to buy. Click on the product, access its file, which includes a detailed description, main characteristics and price. If you need more information, do not hesitate to ask. NOTE: Sometimes the photos of the product may suffer slight variations in color or texture in contrast to the photograph that appears on the web, due to different factors, for example, the resolution of your monitor. However, we will do our best to ensure that the images are as true to the real as possible.

2º.- Once you select the product / s that you want to buy, press the "Add cart" button. you can continue adding more products to the cart if you want, or proceed directly to the payment.

3º.- Once the selection of products has been completed, a summary will appear identifying the selected item / s. Finally, to continue with your order, press the "Buy" button.

4º.- As we have indicated in previous sections, at the end of the procces, you must register, indicating your contact information and address. In your next purchases you will not have to enter your data again, as they will be stored in your User Account.

5º.- At the end, you must accept these Sell Conditions and choose the means of payment that is good for you from among those offered by Mumy Room (see next section).

SHIPPING CONDITIONS

We ship to:

• Balearic Islands

The postage will be free on orders over 59.99€ in the Peninsula. In all other cases, both the shipping price and the delivery time will depend on the shipping area, and will be shown to you before the shopping process concludes.

The courier company usually delivers during business hours, so if you have any time preference for delivery, you can indicate it in the order comments and we will try to work it out (to the extent of the route and schedule possibilities of the transportation).

Delivery times

The delivery time is shown during the purchase process, and it implies your acceptance of it. If a specific date is not indicated, the LGDCU will be attended to, which indicates that the maximum delivery period will be 30 calendar days from the conclusion of the contract.

In case of non-compliance with delivery times, you must indicate an additional period appropriate to the circumstances that caused the initial delay. In case that we are unable to deliver the order within that additional period, you may end the contract.

The previous paragraph will not apply if the delivery period is essential in view of all the circumstances that concur in the conclusion of the contract or when you have informed us, before the purchase, that delivery before a certain date is essential or on a certain date, in such cases; you can end the contract immediately.

Anyway, if the contract is ended, the money paid will be fully reimbursed.

In some cases and depending on the availability of the product, a stock-out (lack of stock) may occur. Our staff will contact you to look for a solution and to inform you of the delivery time once the selected product is available.

IMPORTANT: In general, we are not responsible for the breach or delay of obligations that are due to causes beyond our control, such as in cases of force majeure (confinement due to a state of alarm, for example), natural disasters, strikes, accidents, etc. In case of any incident happens, we will contact you to solve the incident.

Prices, taxes, fees and duties

Prices are expressed in Euros.

The prices of Mumy Room´s products may vary, but (except as stated above) possible changes will not affect orders when a Shipping Confirmation has been already sent.

The price of articles with a shipping address to the Peninsula and the Balearic Islands includes VAT.

For its part, the RRP of articles with a shipping address to the Canary Islands or Ceuta and Melilla, does NOT include VAT, since the operation is treated as an export. The price indicated in each article is the final price of the same for shipments to these CCAA. Mumy Room will not be responsible for the DUA or import expenses and taxes (ISPI, IGIC), fees or duties that are generated at the destination customs, if applicable.

 

Cancellation of accounts and service, cancellation and blocking

User accounts are not deleted for lack of use. The User can unsubscribe by requesting it from the "Mumy Room" staff, sending an email to 9633813@gmail.com or through their account profile.

In case of an unpaid order, it may be temporarily suspended until the situation of non-payment has been resolved by the User. If more than 15 days have elapsed, "Mumy Room" may proceed to cancel the order.

"Mumy Room" reserves the right to block access to the User account without prior notice (or directly delete the User account), if it is used in an illegal way or does not comply with the obligations and rules established herein, a fact that will be communicated by email. The blocking or elimination of the User account will have no effect on the obligation to pay for the products purchased, if applicable.

In exceptional cases, under the free discretion of the administrators of "Mumy Room", and evaluating the seriousness of the fact, administrators may choose to warn the offending User, before eliminating or blocking the account definitively.

By registering as a User, you agree that the owners of this website reserve the right, being able to act at any time and without prior notice, to modify or discontinue this website and its services, or to delete data provided, either temporarily or permanently.

Each order has ONE free size change. The following changes of the same order will be borne by the customer.

You have fourteen (14) days to make the change for free with pick up at your home, once this period has elapsed you can make the change, paying for the transport within 15 days and being able to choose the courier agency that you wish, if it is by national mail we will only accept shipments if they are certified or delivered to our facilities, otherwise the mail will return it to the sender.

In order for us to approve a return, the items must be in perfect condition, with the exterior and interior labels and keep the original packaging. It is only possible to process returns of products purchased in the online store.


ISLANDS / CEUTA / MELILLA:


The cost of the return is borne by the customer, being able to choose the courier agency they want.

The return period is 30 days that will count from the day the order is delivered.

Once we receive your return, we will send you the new garment at no cost.

TERMS

Products must be returned:

- In its original form, together with any accessory related to them, and cannot be used, washed or damaged.

- With its original labels.

Otherwise, the return may be denied.

RETURNS:

At Mumy Room we pursuit the full satisfaction with your order. Therefore, we provide you with several methods to make the return of an item that may not meet your needs or expectations. Possible cases of return or withdrawal:

A. The product is wrong, has a defect or has been damaged during transportation:

We make really sure that all our items and shipments are in perfect condition. Nevertheless if you receive a wrong or defective item, contact us immediately through 9633813@gmail.com or by calling +34 910406915. Before opening the product, check that the packaging matches the one requested: color, measure, finish, etc. In case of any anomaly, also make a claim as soon as possible.

When the product has been damaged during transportation, it is essential that you notify us and if possible write down the incident on the carrier's delivery note.

The products must be returned in a way that they are protected, using a protective box or bag if possible. Mumy Room offers the buyer a courier company for the removal of the return package, completely free of charge. If you want to send the return package with a different courier company than the proposed by Mumy Room, and the selected courier company offers higher rates, you must pay for it.

B. Withdrawal:

We don't want you to keep anything you don't like, so you can return an item if it doesn't meet your expectations. Therefore, in accordance with the provisions of the LGDCU, and being the buyer of an item for private use, you have the Right of Withdrawal, by which you can return the product, always that it is not a digital product of which download has started.

The exercise of this right of withdrawal will have to be carried out within a maximum period of FOURTEEN (14) calendar days from its receipt. In order to exercise this right, the product must be in perfect condition and keep the original packaging, as well as all the parts. In case the products do not arrive in perfect condition, Mumy Room reserves the right to pay a lower amount in the return, a circumstance that will be notified to you.

The full refund of the purchase withdrew will be made through the same means of payment used in the original purchase once the condition of the items returned has been verified and in any case before 14 calendar days have elapsed from the actual receipt of the withdrawal request, as long as it is Mumy Room who manages the collection of the items. In case that you return the items through a courier company of your choice, the period of 14 days will begin to count as soon as Mumy Room has effective knowledge of the shipment of the items or, failing that, from reception of the items.

The return costs derived from the exercise of the right of withdrawal will be paid by the costumer.

No refunds will be accepted freight collect.

The amount of urgent shipments will not be refunded.

GURANTEE

Except for those products excluded from the consumer goods warranty regulations by their nature, all our products are guaranteed nationwide, against manufacturing defects for two years from the date of purchase (or delivery date if it is later).

We will respond to the lack of conformity, of which the buyer must report within two months of becoming aware of it.

If the defect or lack of conformity comes up in the first 6 months from the delivery of the item, whether it is a new product or second-hand, it is presumed that the defect or lack of conformity already existed when the product was invoiced. (or delivered, if it is at a later time), that is, that there is an origin or factory defect of the product, unless we can demonstrate that the defect or lack of conformity is not of origin but is due, for example, to a bad use or maintenance given by the buyer.

In case of a defective product, we may proceed, as appropriate, with the repair, replacement, price reduction or termination of the contract, procedures that will be totally free for the buyer (including transportation costs, if any).

Therefore, defects and damage caused by external events, accidents, misuse or habitual wear and tear are excluded from the guarantee. Also, products modified or repaired by the client or any other person not authorized by Mumy Room, as well as products that are the subject of a specific contract. In these cases, the repair is on the costumer expense.

By regulation, and unless proven otherwise, it will be understood that the products are in accordance with the contract as long as they meet all the requirements expressed below:

a) Products adjust to the description made and possess the qualities of the product that we have presented to the consumer and User in the form of a sample or model.

b) Are suitable for the uses to which similar products are ordinarily intended.

c) Present the usual quality and performance of a product of the same type that the consumer and User can reasonably expect, taking into account the nature of the product.

CONFLICT RESOLUTION
